Party Wall Expert Witness Surveyors
Most party wall disagreements are resolved through the statutory machinery of the Party Wall etc. Act 1996. But when an award is appealed to the County Court, when damage claims outgrow the award, or when a building owner has started work with no notice at all, the dispute moves into litigation — and the court expects independent expert evidence, not partisan argument. Prince Surveyors provides CPR Part 35 compliant party wall expert witness reports for building owners, adjoining owners and their solicitors across London and the Home Counties.
When a Party Wall Dispute Needs an Expert Witness
- Appeals against party wall awards under section 10(17) of the Act, where the court needs an independent view of whether the award was properly made.
- Damage claims where cracking, movement or water ingress is alleged to result from notifiable works — including causation analysis against the schedule of condition.
- Works started without notice, where injunctions and claims in trespass or nuisance turn on what the Act required.
- Surveyor conduct disputes, including challenges to fees and to the validity of appointments.
What Our Reports Contain
Every report is prepared to CPR Part 35 and the RICS practice statement Surveyors acting as expert witnesses: a clear statement of instructions, the factual and documentary evidence relied on, site inspection findings, reasoned opinion on the technical questions, and the expert’s declaration. Our overriding duty is to the court — not to the party paying — which is precisely what makes the evidence persuasive.
Why Prince Surveyors
Our surveyors administer party wall matters week in, week out across London, from notices and awards to schedules of condition, so our expert evidence is grounded in current practice rather than theory. We act for claimants, defendants and as single joint expert.
Frequently Asked Questions
Can my party wall surveyor act as my expert witness?
Usually not. A surveyor appointed under section 10 has a statutory role in the dispute and will rarely have the independence the court requires. A fresh expert with no prior involvement is almost always the safer route.
How quickly can a report be produced?
For most party wall matters we deliver within two to three weeks of inspection, and faster where court deadlines demand it.
