Lease Extensions
Under the statutory route, most qualifying leaseholders have the right to add 90 years to a flat lease at a peppercorn ground rent. Our chartered surveyors handle the full journey: an initial premium assessment so you know what a realistic settlement figure looks like, preparation and service of the Section 42 notice through your solicitor, negotiation with the freeholder’s surveyor, and — where agreement cannot be reached — representation before the First-tier Tribunal (Property Chamber). Because we also carry out leasehold extension and enfranchisement valuations in-house, your negotiating position is built on evidence, not estimates.
Collective Enfranchisement and Freehold Purchase
Where at least half of the flats in a qualifying building act together, the leaseholders can compel the freeholder to sell them the freehold. We advise residents’ groups on eligibility, apportionment of the purchase price between participants, valuation of the freehold interest (including any development value in lofts, basements or airspace), and negotiation strategy through to completion. For leasehold houses, we advise on the individual right to acquire the freehold.
Right to Manage and Ongoing Building Management
Not every building needs to buy its freehold to escape poor management. The Right to Manage allows qualifying leaseholders to take over the management function without proving fault and without paying a premium. Once management is in your hands, our established block management team can take on service charge budgeting, maintenance, insurance and compliance — a combination few surveying practices can offer under one roof.
